This certificate, as provided by section.XVIII of
the 1865 Ordinance, is conclusive evidence that the requisitions necessary for registration have been complied with.
It may be noted that registration carries with it a power to hold land and therefore a Company sa registered may apply to become the holder of land on any Consular Register.
That any seven or more persons should be able to form themselves into an Incorporated Company is considered by many writers on such matters in England to be a dangerous power and as calling for strict regulation.
The Hongkong Ordinance, however, having followed the Imperial Acts in this matter, His sjesty's Consuls cannot do otherwise than protect British Companies, as such, whatever may be the nationality of the individual Directors, Managers, or Share-
holders.
Protection is primarily to be accorded to the business carried on and the property of the Company.
If personal protection is a necessary part of such protection of the Company's business it should, so far as may be necessary, be afforded to those employed therein, and in the course of such employment, but not further.
I can quite appreciate Mr. Lansfield's difficulties in the matter, but I think there is no doubt but that the low being as it is the first question put by Ir. Mansfield in his despatch to yourself must be answered in the affirmative.
It is to be remembered that a British Company being cmenable to English Law those dealing with such a Company in Canton or elsewhere in Chine have this advantage, that the whole property of the Company is attachable, in case of need, by Her Lajesty's Courta.
The property and business of a British Company is, in my opinion, entitled to British protection and in the conduct of such business the persons of those carrying it on, the Company
